9th Circuit: Federal District Courts Have Jurisdiction Over Guantanamo Detainees
In an opinion published today, Judge Reinhardt of the Ninth Circuit says that U.S. District Courts have jurisdiction to hear habeus corpus petitions from "enemy combatants" held by the U.S. at Guantanamo Bay, Cuba. Judge Graber dissents. The opinion in Gherebi v. Bush is here.
