Bad News for Bad Lawyers
Getting bad lawyers out of the legal profession isn't cheap. Just ask State Bar of California officials who have calculated that policing their own puts the agency in a financial hole to the tune of about $600,000 a year.But that might be changing soon as agency leaders push aggressive new measures that could force errant attorneys to pay a substantial portion of the costs of their own prosecution in State Bar Court.

*N.Y. STATE OVERTURNS RULES ON ANNOUNCING PESTICIDE USE
Regulations that would have required various commercial and public
establishments to post signs on the days they planned to use pesticides have
been overturned by a New York State Supreme Court judge. The rules, which were
issued last year by the state Department of Environmental Conservation, were
to have gone into effect on January 1 but were delayed because of the many
lawsuits that were filed. Justice Paul E. Cheeseman said that in instituting
the regulations, the department had overstepped its authority, and had ``under
the color of regulatory authority actually rewritten and extended the law.''
The 1983 legislation under which the rules were adopted required only that
commercial establishments provide, on request, a copy of the label of any
pesticide being used. The posting requirements would have applied to
restaurants, hotels, shopping malls, schools, parks, libraries, hospitals,
train and bus stations, airports, office buildings, and department stores,
among others. Such notices would have put ``a huge damper on business,'' said
Kerry D. Marsh, a lawyer representing several restaurant and hotel
associations. ``Anyone who saw a sign about a pesticide application would come
to the conclusion that the establishment was infested,'' he said, when in
reality ``it was just a maintenance program to keep the establishment pest-
free.''

I WAS IN A CAR ACCIDENT 2/23/2002. I WASNT DRIVING AND DIDN'T OWN A CAR AT THE TIME. AS OF RIGHT NOW MY CASE IS STILL PENDING AND MY ATTORNEY WON'T RESPOND TO ANY OF MY MESSAGES FOR A UP-DATE OF THE CASE. SOME TIME IN THE EARLY PART OF LAST YEAR A OFFER WAS MADE BUT I HEAR NOTHING ABOUT IT, UNTIL I WENT TO THE OFFICE AND WAITED THREE HOURS BECAUSE NO ONE RETURNED MY CALLS THEN IT WAS LIKE THREE TO FOUR MONTHS THAT I FOUND OUT ABOUT THE OFFER AND THAT MY ATTORNEY TURNED IT DOWN. DOES THIS SOUND RIGHT? I DONT THINK SO AND I WANT TO KNOW WHAT CAN I DO ABOUT THIS ATTORNEY!!!!!!

I GOT INTO I BAD ACCIDENT ON 5/20/05. I WASN'T THE DRIVER. MY LAWYER DONT NOT RESPOND TO ANY OF MY CALLS. HE TOLDHE WAS GOING TO GET ME MY LOST WAGES SAID HE WORK ON IT, UP TILL NOW I DID GET ANYTHING. I CALL HIM HE SHE HIS SECRETARY DIDNT FILE IT. IT IS 7 MONTH AND SHE DIDNT FILE IT. I CALL THE NEXT WEEK, ASKED FOR MY LOSS WAGES HE TOLD ME " WHY AM I WORRYING ABOUT MY LOSS WAGES ITS NOT IMPORTANT MY SETTLEMENT IS" WHAT CAN I DO ABOUT THIS ATTORNEY????

Chris, You need to demand that your attorney withdraw from the case and have him sign a Lien Release.

My attorney did not ever interviewed me or asked me anything about my case and charged 65 hours for preparing for trial. At the Hearing she was not prepared at all. She had no exhibits and was rambling the whole time. I took her to SD Bar for arbitration. Two of the three arbitrators congratulated me in doing an excellent job presenting the evidence during the Hearing. The final decision was for the attorney that charged me 35K for doing nothing. What went wrong? It was incredible. She did not have any documentation of anything and when asked questions she had no aswers. What's wrong with the San Diego Bar Association? Are they nuts? Let a legal skunk walk on the streets of San Diego taking money from inocent victims.
