Legal Assistant Says Attorney Is Notoriously Mean To Staff
OKLAHOMA CITY (CN) – A legal assistant at the firm Hayes, Magrini and Gatewood claims John Hayes yelled at her, belittled her, pushed her around and made her cry. Holli Gould has sued Hayes for assault and battery in Federal Court, claiming he used to approach her from behind as she was working at her desk, wearing headphones for dictation, and “frogged” her on the arm to get her attention. She says his attacks scared and physically hurt her to the point of tears. He once impatiently told her to “get out of his way” so he could find an envelope, pushing her so that she nearly toppled over in her heels, she claims. When she later asked him not to swear at her, he replied, “You listen here – I’m the boss. I will behave however I like,” the complaint states. On another occasion, she says Hayes angrily grabbed her arm, stuck his face within an inch of hers and hissed, “Goddammit, when I ask you a question, you don’t sit there for a goddamn 15 seconds before answering me, do you hear me?” Gould claims Hayes has a reputation for abusing his staff. And when she approached his senior partners for advice, they allegedly told her to “just smoke a joint before work” and “picture John Hayes in a dress.” She is represented by Rand Eddy. See complaint.
That sounds like reasonable advice to me . . . . Details from Courthouse News Service which, unfortunately, does not provide targeted links to its individual stories.

This behavior reminds me of the general loutishness of say, Don Imus.
.
Trouble is, the courts aren't known as a haven for victims of misogyny.

I would have physically defended myself and called the police to report the assault. At least she is seeking damages in court.

Reasonable advice? Why don't you go fuck yourself?

I know that partners are supposed to stick together. But this is quite ridiculous. I suppose if Ms Gould had and I quote ‘Just smoke a joint before work’ they would has dismissed her for taking drugs. I understand that there are audiotapes to back this claim up. Go get them Ms Gould for NOONE is above the LAW!!!!!!

This kind of thing happens all too often - women support staff being bullied and abused by men in positions of power. One would expect for the complaint to reach the point of a lawsuit, the victim has ample evidence to support her claims. Sounds as though the firm should have listened and tried to resolve the problem when the victim first reported the abuse to senior staff. The fact that the partners apparently ignored repeated complaints made against one man sounds as though they didn't take their staff's concerns seriously. And now their firm's reputation will suffer, as what should have been a private personnel matter is being played out in the courts.

If repeated aggressive assaults were made on Ms. Gould's person and she has proof, this goes way beyond mere misogyny. It's one thing to hate women - another to demonstrate it physically. Otherwise Don Imus would be worried about more than just getting canned by CBS.

My "sounds like reasonable advice to me" comment was meant sarcastically. Of course "smoke a joint before work" or "picture your tormentor in a dress" is not reasonable advice to an employee complaining of being abused. Get a sense of humor, Your Mom.

It's Oklahoma, and the hope is that this small firm is part of some lingering, decrepit, old guard that has yet to figure out, YOU CANNOT BEHAVE THIS WAY AND EXPECT TO NOT BE REPRIMANDED; It's. Not. Possible. Slavery died with the Emancipation, and if you know ANYTHING about the Law, you'll know that we now have rules and regulations in place to govern workplace behavior. When you act outside those R&R, you are are acting outside the law. Pretty simple stuff, not rocket science. What's truly sad and UNFORGIVEABLE is the folks that colluded in enabling the sorry f@#$ to pursue such nonsense. This guy is clearly out of his mind, but to have lucid office staffers, attorneys no less, that allowed the behavior to continue, well there's truly no excuse for that, and I suspect they well know that. Shame on him, and shame on THEM.

Obviously I can't comment one way or another, but I am reading with interest and holding my tongue.
And just for the record, that is not my mother!
If I shouldn't be commenting on this at all, feel free to delete.

I am proud of Holli for standing up for herself and, at the same time, countless others. Everyone should live with such conviction (pun intended). As for the lawyer, I hope he'll take the time to figure out what is making him so miserable and try to change his thinking and, subsequently his behavior.

I work for a court reporting office and we have attorney's in our office on occasion. There have been a few attorney's that have brought me to tears by the ways they treated me and they spoke to me. Some attorney's think that just because they have a law degree they can treat people like dirt. I'm glad that Holli is going after them -- they have no right to treat anyone male or female the way she was treated!

For more than 24 hours all mention of this pending litigation was removed from the search engines. How can a person go about doing something like that? And why would they try to do it. unless they were trying to hide something from the people. The truth is the truth is the truth. Facts don't change.
