Sentencing Tops High Court’s New Term

The Supreme Court returns to the bench Monday to set about cleaning up the sentencing system chaos it created in June. In a rare two-hour afternoon session, the Court will hear arguments in United States v. Booker and United States v. Fanfan, added to its docket in the aftermath of Blakely, which struck down a sentencing system similar to the federal one. Debate continues as to whether Justice Stephen Breyer — who helped set the guidelines — should participate.
