Manslaughter Charges Against Caitlyn Jenner?

Caitlyn Jenner is in the news yet again. This time, it’s not regarding her transition from one of America’s favorite male athletes into an amazingly graceful woman. Pre-transition, she was involved in a fatal automobile accident. Investigators may recommend manslaughter charges against Caitlyn Jenner as early as next week.


Despite the overwhelming acceptance she’s received, including a new reality show, not everything is coming up Caitlyn. The fatal accident in which Ms. Jenner was involved (as Bruce) is still under investigation. In fact, the investigators are seriously contemplating recommending manslaughter charges against Caitlyn Jenner.

The accident resulted in the death of Kim Howe, age 69. Jenner rear-ended Howe sending her vehicle into oncoming traffic. She was hit head-on by a Hummer. Her stepchildren have been waging what is likely to be a losing battle as they try to press a wrongful death suit against Jenner.

Sheriff’s office spokesperson, Nicole Nishida, reported that the investigators concluded that Caitlyn (then Bruce) Jenner’s driving was “unsafe for the prevailing road conditions.” Investigators state that Jenner’s SUV could not have been under proper control for the conditions because it hit Howe’s Lexus from behind.

Of course, it is up to the district attorney to decide Jenner’s charges. Investigators will present their findings for final review next week. If the DA accepts the manslaughter recommendation and Jenner is convicted, she faces up to one year in county jail.

cjOne can only imagine that I Am Cait will not continue filming if Ms. Jenner is jailed. Unless, of course, the authorities decided to make a bit of extra money by cutting a deal with the network. Stranger things have happened.

It would also present a unique question: at what point in the gender transition does one fully become the other gender? I promise, this isn’t a rude question. Technically speaking, Caitlyn Jenner is a woman. However, she made the decision not to reveal whether she was going to have (or did have) genital reassignment surgery. Frankly, it’s no one’s business, either.

Until you look at potentially incarcerating her. If Ms. Jenner opted to not have the genital reassignment surgery, she still has a penis. Is that a potential encroachment on the rights of the other inmates? What if one of them is uncomfortable sharing such close quarters with someone in possession of a penis?

I mean no disrespect to the transgender community. However, in today’s society, such issues come up more and more often. The same question could be raised if a female-to-male transgendered person who still had a vagina was to be incarcerated in a men’s correctional facility.

There are safety issues to be considered, as well. Anti-transgender violence, potential sexual assaults, all of these could be an issue. Granted, such assaults occur even without the transgender aspect, but it could increase the risk. For now, this is all speculation. However, it may soon be necessary to answer these questions.
