When a company brings a medical test or device to market, the public makes a reasonable assumption: somebody proved it was safe and accurate before it reached a patient. Much of the time, that assumption holds. The trouble starts in the cases where the proof was thinner than the marketing implied, and the gap only becomes visible once the product is already in use.
That gap matters more for diagnostics and devices than for most products, because the buyer cannot inspect the thing they are trusting. A patient cannot evaluate whether an assay was properly validated any more than they can audit the clearance file behind it. They rely entirely on the assumption that someone else already did, which is precisely why how that someone behaved under cost pressure is a public question and not only a private one.
What “FDA-Cleared” Actually Means
A great many devices reach the U.S. market without proving safety and effectiveness from scratch. Instead, a manufacturer shows that its product is substantially equivalent to one already on the market, a route that is faster and considerably cheaper than full premarket approval. For well-understood, low-risk products, that bargain is reasonable and works as intended.
The weakness shows up at the tail of the distribution, in the devices where substantial equivalence papered over a real difference. A clearance that rests on comparison rather than fresh clinical evidence carries an assumption that the comparison actually holds. When it does not, nothing in the process necessarily catches the problem before the product is in clinics and homes.
How the Comparison Quietly Drifts
Part of what makes the standard fragile over time is how comparisons chain together. A new device is cleared by reference to an existing one, which was itself cleared by reference to something earlier, back through a lineage that can stretch across decades. Each link looked reasonable on its own, yet the device at the end of the chain can differ substantially from the original it ultimately rests on.
When a product in that chain is later recalled, it does not simply disappear from the record. It may already have served as the reference point for others, which means a single flawed comparison can propagate forward. The process assumes the foundation is sound and rarely revisits that assumption once a clearance is on the books.
Regulators and courts have both taken note of the pattern, and reform proposals have circulated for years. For the public, though, the practical takeaway is simpler than the policy debate. A clearance describes how a product entered the market. It is not a guarantee of how that product will perform once it is in use.
The Recall Record Tells the Story
The pattern is visible in the numbers. Among devices that reached the U.S. market between 2008 and 2017, about one in nine cleared devices was later recalled, a rate that is hard to square with the assumption that clearance settles the safety question. The picture grows sharper at the dangerous end of the spectrum.
An earlier analysis of serious recalls, the kind the FDA judged capable of causing severe harm or death, found that most high-risk recalls cleared without clinical testing had moved through the lighter notification route or were exempt from review altogether. These were not obscure products. They were devices serious enough to hurt people, cleared on a standard that never required them to be tested in patients.
These were also not products subjected to premarket inspection as a matter of course, nor were postmarket studies routinely required to confirm they stayed safe in use. The lighter route trades that scrutiny for speed, which is the right trade for genuinely low-risk products and the wrong one when a device turns out to carry risk no one fully characterized in advance.
Why Careful Companies Still Cut Corners
The reasons are rarely malicious, which is part of what makes the pattern durable. A team underestimates how demanding the analytical and clinical work will be. A consultant raises a concern about an internal capability or a study site, and the team proceeds anyway to protect the budget and the timeline. Each decision is defensible in isolation. Together, they produce a program that is cheaper on paper and far more expensive in reality.
The rework alone usually swamps the savings. A single poor clinical run can force an additional round of testing, adding hundreds of thousands of dollars and months of delay. When the shortfall is discovered after launch rather than before, the cost stops being measured in budget lines and starts being measured in harm.
Investor pressure compounds the problem. A team that should pause to fix a foundational issue often presses on instead, because stopping looks like failure to the people funding it and momentum feels safer than a hard reset. The study that should have been halted continues, and the cost of finishing the wrong program keeps climbing until it can no longer be ignored.
Where the Liability Lands
A device or diagnostic that fails in the field does not fail quietly. It draws product-liability claims, regulatory enforcement, and the slower reputational damage that follows a public recall. Coverage of product recalls, safety alerts, and medical and health legal disputes tends to share a recurring shape: the warning signs existed before the harm did, and someone, somewhere, weighed them against cost and chose cost.
By the time a claim is filed, the documentary record usually tells a coherent story. Internal decisions to defer a study, emails weighing a known risk against a deadline, and a consultant’s flagged concern that was acknowledged and then set aside. None of it looks good in discovery, and none of it is unusual. The same cost pressures that shape the development plan also produce the paper trail a plaintiff’s lawyer will later read aloud.

The people who absorb the consequences are usually the ones with the least say in the trade. A patient acting on a wrong result did not approve the decision to skip a validation study. That asymmetry is exactly what makes thin clearance a consumer-protection issue and not merely a business risk a company accepts on its own behalf.
The Cheaper Path Is Rarely the Cheap One
There is a less dramatic alternative, and it happens before any of this. Prior to committing serious capital and exposing patients, an independent readiness and risk assessment can surface the gaps that a rushed program is built to overlook, while changing the plan is still cheap. It is unglamorous, it slows the early timeline, and it routinely prevents the failures that later look obvious in hindsight.
For a company, the lesson is not that speed is the enemy. It is the one corner that cannot be safely cut that is evidence that the product does what it claims without hurting the person relying on it. Most other things in a development plan are negotiable under pressure. That one is not, and treating it as if it were is what turns a budget decision into a safety event.
