In her ruling, U.S. District Court Judge Melissa R. Dubose wrote that “the record is completely devoid of any evidence that the Defendants have performed any research on the repercussions of issuing and executing the plans announced in the Communiqué.
“The federal government has been the number one driver of pollution in the Anacostia River for over 150 years, treating the District’s iconic natural resource as a cost-free dumping ground for the toxic waste and chemicals it generated,” D.C. Attorney General Brian Schwalb said in a statement announcing the lawsuit.
“Nijjar and his associates have treated lawsuit after lawsuit and code violation after code violation as the cost of doing business and have been allowed to operate and collect hundreds of millions of dollars each year from families who sleep, shower, and feed their children in unhealthy and deplorable conditions,” California Attorney General Rob Bonta said.

DOCCS and OMH continue to subject hundreds of people with disabilities held in state prisons to solitary confinement, which is defined under HALT as “any form of cell confinement…for more than 17 hours a day.”
Based on the jury verdict, total damages for the class comprised of approximately 2,000 policyholders are now estimated at $83.2 million after deducting prior settlement payments. With interest added, total damages are estimated at $211.3 million.
