McKeen & Associates Wins $16.2 Million Medical Negligence Settlement

On June 21, McKeen & Associates announced that it won a $16.2 million settlement on behalf of a child who suffers from cerebral palsy. Medical negligence was determined as the cause of child’s cerebral palsy.


On June 21, McKeen & Associates announced that it won a $16.2 million settlement on behalf of a child who suffers from cerebral palsy. Medical negligence was determined as the cause of child’s cerebral palsy.

In May, McKeen & Associates attorneys Brian McKeen and John LaParl arbitrated in a case alleging that a child’s cerebral palsy was the result of negligent medical care after the child’s premature birth. As a result of the negligent care, the child requires life-long 24-hour care. The settlement required a nondisclosure of the child and medical personnel’s identities.

“Nothing will ease the suffering of this child, but at least this settlement will alleviate some of the financial burden from his caretakers,” said Brian McKeen, managing partner of McKeen & Associates. “Premature infants require intense, expert and specialized care, and these medical professionals failed at providing that care.”

According to the Mayo Clinic, “Cerebral palsy is a disorder of movement, muscle tone or posture that is caused by damage that occurs to the immature, developing brain, most often before birth.

Signs and symptoms appear during infancy or preschool years. In general, cerebral palsy causes impaired movement associated with abnormal reflexes, floppiness or rigidity of the limbs and trunk, abnormal posture, involuntary movements, unsteady walking, or some combination of these.

People with cerebral palsy may have problems swallowing and commonly have eye muscle imbalance, in which the eyes don’t focus on the same object. People with cerebral palsy also may suffer reduced range of motion at various joints of their bodies due to muscle stiffness.

Cerebral palsy’s effect on functional abilities varies greatly. Some affected people can walk while others can’t. Some people show normal or near-normal intellectual capacity, but others may have intellectual disabilities. Epilepsy, blindness or deafness also may be present.”
